Judge Rules Clear Channel Exec Can't Join TribCo -- For Now

CHICAGO - Tribune Co. and Clear Channel return to federal court Wednesday to set a hearing on whether a former key executive of the radio giant can work at the Chicago newspaper and media company before the end of the year.
U.S. Judge District Court Judge Joan Gottschall has granted Clear Channel's request for a temporary restraining order preventing Andrew Friedman from taking his new job as vice president of Tribune's interactive division.
Clear Channel contends in a lawsuit against Tribune Co. filed last week that Friedman, who was also named as a defendant, was in charge of building its online business, and that he left Clear Channel with proprietary information.
Gottschall ordered Friedman to return any documents or devices with confidential Clear Channel information. The judge's rulings were first reported Tuesday by Lorene Yue on Crain's Chicago Business' Web site.
Clear Channel asserts that it has a non-compete clause with Friedman that would keep him from Tribune until after Dec. 31. Crain's reported Friedman's response in court documents is that the non-compete requirement does not apply because he rejected his severance package.
Friedman was also barred from trying to hire away Clear Channel employees. Since Chairman and CEO Sam Zell took Tribune private last December, he has hired several former Clear Channel employees, including the current Tribune CFO, Randy Michaels, who left the radio chain in 2002.
